These Terms & Conditions govern the use of the Kocher website and all purchases, rentals, and services provided by Kocher. By using this website or placing an order, you agree to these Terms.

About Kocher

Kocher is an independent design house based in Barcelona, Spain, specializing in sculptural fashion, accessories, jewelry, and wearable objects through traditional craftsmanship and digital fabrication. Kocher is operated by an individual private seller, not a corporation. Many products are produced using additive manufacturing (3D printing), hand-finishing techniques, and limited production methods. Slight variations between pieces are part of the design and are not considered defects.

Products

Kocher offers three categories of products.

Ready to Ship

Products already manufactured and available for immediate dispatch. Ships within 1-3 business days. Eligible for returns in accordance with applicable consumer law.

Made to Order

Products manufactured only after an order has been placed. These are existing Kocher designs produced specifically for each customer. Production time is generally 2-4 weeks, although this may vary depending on production volume and the handmade nature of the work. Orders may be cancelled only before production has begun; once production has started, cancellation may no longer be possible. Products that include customer-selected personalization or modifications may not qualify for the standard withdrawal right under applicable law.

Custom Commission

Products designed or significantly modified specifically for one customer, including custom colours, custom sizing, personalized engraving, bespoke structures, and unique design requests. A 50% non-refundable deposit is required before work begins. Once production has started, orders cannot be cancelled. Custom commissions are non-returnable except where required by law or if the product is defective.

Pricing

All prices are displayed in Euros. Applicable taxes are calculated during checkout where required. Shipping costs are calculated separately. Kocher reserves the right to update prices at any time without prior notice.

Payment

Payment is processed securely through Shopify and its approved payment providers. Orders begin production only after payment has been successfully received.

Product Characteristics

Kocher products are produced using digital fabrication and handcrafted finishing techniques. Characteristics such as visible layer lines, slight colour variation, minor texture differences, and natural finishing marks are intentional characteristics of the manufacturing process and are not defects.

Rentals

Rental garments remain the property of Kocher at all times.

Rental Period

The rental period begins on the agreed delivery date and ends on the agreed return date.

Security Deposit

A refundable security deposit may be required before shipment. The deposit amount is determined by Kocher based on the value of the rented item. The deposit will be refunded after inspection if the garment is returned on time and in its original condition.

Late Returns

Late returns incur a charge of 20% of the rental fee per calendar day. If an item is not returned within 7 days after the agreed return date, Kocher reserves the right to charge the customer the remaining retail value of the garment.

Damage

Customers are responsible for any damage beyond normal wear. Charges may apply for stains, tears, burns, missing accessories, unauthorized alterations, and permanent odours. Repair or replacement costs may be deducted from the security deposit.

Cleaning

Rental garments must not be washed, dry-cleaned, altered, or repaired by the customer unless expressly authorized by Kocher. Professional cleaning is performed by Kocher.

Lost Items

Lost or stolen rental items will be charged at their full retail value.

3D Design Services

Kocher provides product design, fashion design, jewelry design, CAD modeling, technical drawings, 3D printing, prototyping, and design consultation.

Quotations

All quotations are valid for 30 days unless otherwise stated.

Payment

Projects require a 50% deposit before work begins. The remaining balance must be paid before final files, prototypes, or products are delivered.

Revisions

Unless otherwise agreed, each project includes two rounds of revisions. Additional revisions are billed separately.

Intellectual Property (Design Services)

Unless expressly transferred in writing, Kocher retains ownership of concepts, sketches, CAD files, technical drawings, prototypes, and manufacturing methods. Clients receive only the rights specifically agreed in writing.

Confidentiality

Kocher treats client information as confidential. Clients also agree not to reproduce, distribute, or disclose Kocher's proprietary designs, methods, or technical documentation without written permission.

Warranty

Manufacturing defects are covered for 12 months from delivery. The warranty does not cover accidental damage, misuse, improper storage, excessive heat exposure, or normal wear and aging.

Limitation of Liability

To the fullest extent permitted by law, Kocher shall not be liable for indirect, incidental, or consequential damages arising from the use of its products or services. Kocher's total liability shall not exceed the amount paid for the relevant order.

Intellectual Property

All website content, including designs, photographs, renders, logos, text, graphics, CAD models, and other creative works, is the exclusive property of Kocher unless otherwise stated. No content may be copied, reproduced, distributed, or used without prior written permission.

Governing Law

These Terms & Conditions are governed by the laws of Spain. Any disputes shall be subject to the jurisdiction of the courts of Barcelona, Spain, unless mandatory consumer protection laws provide otherwise.
